Without a Quorum Present, Planning Board Members May Meet with Staff Without Violating the Open Meetings Law

The NYS Committee on Open Government has opined that the Open Meetings Law is not triggered unless a quorum, a majority of the total membership of a public body, convenes to conduct public business collectively, as a body.  So, where the planning board consists of seven members, a quorum would be four or more members.  Therefore, a gathering of two members of the planning board with municipal staff would not constitute a meeting and the Open Meetings Law would not apply.
