Legislative Body Not Required to Consider and Vote on Every Application for Zoning Change

A Town Board is not required to consider and vote on every application for a zoning change.  Since the Board’s decision not to consider the application is a legislative function (adoption of zoning and amendments thereto are legislative actions), the decision is not subject to an Article 78 review under the New York Civil Procedure Law and Rules.
