NY Appellate Court Upholds Granting of Special Permit for Natural Resources

An appellate court in New York upheld the determination of the zoning board of the Town of East Hampton which granted a natural resources special permit to the Nature Conservancy, noting that Board’s action was not illegal, it had a rational basis, and it was neither arbitrary nor capricious.

Birch Tree Partners, LLC v Nature Conservancy, 2014 WL 6462234 (NYAD 2 Dept. 11/19/2014).
